I actually would have top consult my bird-obsessed 9 yo son to be sure, but I think it's a Swainson's Hawk

well .... here's the track so far .......
from the 3rd pic (actually 1st pic I had), bird guy at work noted juvenile peregrine. And with the clearer pics same thoughts.
BUT ....... I saw a pic of a juvey Merlin somewhere online - and by-George it looks smashingly similar ........ but - smaller.
This guy (or gal) is 16+ inches in length - too tall for a Merlin. So I go hmmmmmmssss ..............

Immature Prairie Merlin.
Basically, with Prairie Falcons and Peregrins they (even immature and sub adults) have the moustache.

thanks all - we've stayed our course - Juvey Merlin fuzzy pic still haunts us because it was definately bigger than the Merlin - but fuzzyness (and me not knowing full use / settings of camera ......... ) ah well .......... it took out a bird - in the hangar - while watching ........ ;D coolness

I'd guess it is a Sharp-Shinned Hawk judging by the eye colour. I picked up a road killed SSH near Dugald a few years ago. The local conservation department wouldn't issue me a permit to have it mounted unfortunately and confiscated the bird.
